SBF Appeals Conviction, Accuses Judge of Bias
On September 13, lawyers representing former FTX CEO and co-founder Sam Bankman-Fried filed a formal appeal in New York seeking a new trial, arguing that the federal judge presiding over his high-profile fraud case was deeply biased against him.
Why Sam Bankman-Fried Is Demanding a New Trial
The fallen cryptocurrency mogul, who was convicted of massive fraud and money laundering late last year, claims he did not receive a fair trial. According to Bloomberg reports, Bankman-Fried’s legal team is focusing its appeal on the courtroom behavior of U.S. District Judge Lewis Kaplan. The defense alleges that Kaplan’s judicial rulings were “not just erroneous but unbalanced,” creating an environment that heavily favored the prosecution.
Allegations of Judicial Bias and Jury Manipulation
The appeal filing paints a picture of a hostile courtroom environment. Defense lawyers claim that Judge Kaplan “continually ridiculed” Bankman-Fried throughout the trial, repeatedly criticized his demeanor, and overtly signaled his disbelief of Bankman-Fried’s testimony to the jury. Furthermore, the defense argues that Kaplan “repeatedly mocked defense counsel” while actively helping the government construct its case, ultimately “improperly prodded” jurors to reach a rapid guilty verdict.
The Original Conviction and Current Status
Following the spectacular collapse of his cryptocurrency exchange FTX, Bankman-Fried was found guilty on all seven criminal counts, including wire fraud and conspiracy to commit money laundering. He was subsequently sentenced to 25 years in federal prison and ordered to pay $11 billion in forfeiture. Bankman-Fried is currently serving this sentence at a federal facility in Brooklyn.
Through this new appeal, Bankman-Fried’s legal representatives are requesting a completely new trial under a different, impartial judge. The U.S. Attorney’s office that prosecuted the landmark case has stated that it does not plan to comment on the newly filed appeal.
